1. Who we are

This website, kids-planet.co.uk (the "Site", trading as "kids-planet", "we", "us", "our"), is operated by:

Ziad Limited is the trader and the seller of all goods offered on this Site, and is the party with whom you enter into a contract of sale. We are a company incorporated in Hong Kong and we sell and dispatch goods to customers in the United Kingdom.

2. About these Terms

2.1 These Terms of Service (the "Terms") govern your use of the Site and every contract for the sale of goods that we conclude with you through the Site. Please read them carefully before you place an order.

2.2 By using the Site or placing an order, you confirm that you accept these Terms. If you do not accept them, please do not use the Site.

2.3 These Terms are written in English and every contract concluded under them is concluded in English.

2.4 These Terms apply in addition to the following policies, which form part of your contract with us:

2.5 The Site is intended for consumers, that is, individuals acting wholly or mainly outside their trade, business, craft or profession. If you are buying as a business, sections 11 and 12 apply to you in a modified form as set out in section 13.

2.6 You must be at least 18 years old, or the age of legal majority where you live, to place an order.

3. How a contract is formed

3.1 The display of goods on the Site is an invitation to treat, not a binding offer. Your order is an offer to buy the goods from us.

3.2 After you place an order you will receive an order acknowledgement by email. This acknowledgement confirms that we have received your order. It does not, by itself, mean that we have accepted it.

3.3 The contract of sale between you and Ziad Limited comes into existence only when we send you a dispatch confirmation email for the goods concerned. If your order contains several items, a separate contract is formed for each item as and when it is dispatched.

3.4 If we are unable to accept your order — for example because the item is out of stock, because we cannot obtain authorisation for your payment, because a price or description was clearly wrong, or because we cannot lawfully ship the item to your delivery address — we will tell you by email and will not charge you. If payment has already been taken, we will refund it in full.

3.5 We may refuse or cancel an order where we reasonably suspect fraud, or where the order is placed for resale rather than for personal use.

4. Products, descriptions and images

4.1 We take care to describe our products accurately. Product images, colours and dimensions are shown as accurately as possible, but small variations can occur and screen settings differ from device to device. Minor variations of this kind do not make the goods faulty.

4.2 Packaging may differ from the packaging shown in images.

4.3 Where a product carries a safety, age or usage warning, please read it before use and keep it with the product.

4.4 We may correct obvious typographical errors, pricing errors and inaccuracies on the Site at any time, including after you have submitted an order. If the correction affects an order you have already placed, we will contact you before dispatch and you may confirm the order at the corrected price or cancel it for a full refund.

5. Prices and currency

5.1 All prices are shown in pounds sterling (GBP).

5.2 The price of a product is the price shown on the product page at the time you place your order, except in the case of an obvious error covered by section 4.4.

5.3 Delivery charges, where they apply, are shown separately and are added to the price before you complete your order. The total amount payable is shown to you at checkout before you confirm the order.

5.4 Any taxes, duties or import charges that may apply to your order are dealt with in our Shipping Policy. Because our goods are dispatched to the United Kingdom from outside the United Kingdom, please read that policy before ordering.

5.5 Where a product is shown alongside a higher reference or "was" price, that reference price is a genuine price at which we previously offered the product for sale. We do not display reference prices that were never charged.

5.6 We may change our prices at any time, but changes do not affect orders for which a contract has already been formed under section 3.3.

6. Payment

6.1 The payment methods we accept are shown at checkout.

6.2 Payment is taken through our payment service providers. We do not store your full card details.

6.3 Payment is due at the time you place your order. Goods are dispatched only once payment has been received in full and cleared.

6.4 If your payment is declined or reversed after dispatch, we may suspend or cancel further orders and take reasonable steps to recover the amount due.

7. Delivery

7.1 We deliver to addresses in the United Kingdom. Delivery areas, dispatch times, estimated delivery windows and delivery charges are set out in our Shipping Policy.

7.2 Delivery times given on the Site and in the Shipping Policy are estimates. Unless we have agreed a specific delivery date with you in writing, we will deliver the goods without undue delay and in any event within 30 days of the day the contract is formed.

7.3 If we fail to deliver within the period in section 7.2, you may treat the contract as at an end and receive a full refund, in accordance with the Consumer Rights Act 2015.

7.4 The goods become your responsibility once they are delivered to the address you gave us, or to a person you nominated to take delivery. Risk of loss or damage in transit stays with us until that point.

7.5 Please give us a complete and accurate delivery address. We are not responsible for delays or non-delivery caused by an incorrect or incomplete address supplied by you.

7.6 We are not liable for delays caused by events outside our reasonable control (see section 15), but we will contact you as soon as possible and, if the delay is substantial, you may cancel the order and receive a refund for goods not yet delivered.

8. Your right to cancel (14-day cooling-off period)

8.1 If you are a consumer, you have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right applies in addition to, and does not affect, your rights if goods are faulty (section 9).

8.2 You may cancel at any time from the moment you place your order until 14 days after the day on which you, or a person you nominated, receive the goods. Where an order is delivered in several consignments, the 14-day period runs from the day you receive the last item.

8.3 To cancel, tell us clearly before the period ends — for example by emailing support@kids-planet.co.uk. You do not have to give a reason. The full procedure, including the cancellation form and the return address, is set out in our Refund Policy.

8.4 After cancelling, you must send the goods back without undue delay and in any event within 14 days of telling us. Who pays the cost of return, and the return address, are stated in our Refund Policy.

8.5 We will refund all payments received from you, including the standard delivery charge you paid on the original order, within 14 days of the day we receive the goods back or, if earlier, the day you supply evidence that you have sent them back. If you chose a delivery service more expensive than our standard option, we refund the standard cost only.

8.6 We refund using the same payment method you used, unless you agree otherwise. Refunds are free of charge to you.

8.7 We may reduce the refund to reflect any reduction in the value of the goods caused by you handling them beyond what is necessary to establish their nature, characteristics and functioning — in other words, more than you could have handled them in a shop.

8.8 Certain goods are excluded from the statutory right to cancel, including sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed, and goods made to your specification or clearly personalised. Any exclusions that apply to our range are listed in our Refund Policy.

8.9 Your right to cancel applies to all products, including reduced or promotional items.

9. Faulty goods — your rights under the Consumer Rights Act 2015

9.1 If you are a consumer, we are under a legal duty to supply goods that are in conformity with the contract. Under the Consumer Rights Act 2015, the goods we supply must be:

  • of satisfactory quality;
  • fit for any particular purpose you made known to us before buying; and
  • as described, and matching any sample or model shown to you.

9.2 If the goods are faulty, not as described or not fit for purpose, you have the following statutory remedies:

  • Within 30 days of delivery: you have the short-term right to reject the goods and receive a full refund.
  • Within 6 months of delivery: if the fault cannot be put right by one repair or replacement, you are entitled to a full or partial refund. Goods that develop a fault within the first 6 months are presumed to have been faulty at the time of delivery unless we can show otherwise.
  • Up to 6 years from delivery (5 years in Scotland): you may still be entitled to a repair, replacement or a price reduction, depending on the circumstances.

9.3 To exercise these rights, contact us at support@kids-planet.co.uk with your order number and a description of the fault, with photographs if possible. We will not charge you for returning faulty goods.

9.4 Nothing in these Terms affects your statutory rights as a consumer. If any part of these Terms conflicts with those rights, your statutory rights prevail.

9.5 Any voluntary guarantee we or a manufacturer may offer is additional to, and does not replace, your statutory rights.

10. Intellectual property

10.1 All content on this Site — including text, product descriptions, graphics, logos, button icons, images, audio and video material, page layout, design and software — is owned by Ziad Limited or its licensors and is protected by the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994 and equivalent intellectual property laws in the United Kingdom and internationally.

10.2 You may view, download and print pages of the Site for your own personal, non-commercial use. Any other use — in particular reproduction, distribution, public display, adaptation, systematic extraction or commercial exploitation of any part of the Site — requires our prior written consent.

10.3 Third-party trade marks, brand names and product names appearing on the Site are the property of their respective owners and are used only to identify the goods concerned. Their appearance does not imply any endorsement or affiliation.

10.4 If you believe that content on this Site infringes your intellectual property rights, please contact us at support@kids-planet.co.uk with details of the right concerned and the material in question so that we can investigate.

11. Use of the Site

11.1 You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of the Site by, anyone else.

11.2 You must not:

  • use the Site for any fraudulent or unlawful purpose;
  • transmit any virus, malicious code or other harmful material;
  • attempt to gain unauthorised access to the Site, its servers or any connected system;
  • scrape, harvest, crawl or systematically extract data from the Site by automated means without our written permission;
  • interfere with the security or proper working of the Site; or
  • submit content that is unlawful, defamatory, obscene, threatening or infringes the rights of others.

11.3 If you submit any content to the Site — for example a product review or a comment — you confirm that it is your own, that it is accurate and lawful, and you grant us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with the Site. We may remove content that breaches these Terms.

11.4 We may suspend or withdraw access to the Site, or refuse service to any user, where there is a lawful reason to do so. We will give notice where it is reasonable to do so.

11.5 We take reasonable care to keep the Site available, but we do not guarantee that it will be available uninterrupted or free of errors. We may suspend, withdraw or change all or part of the Site for business or operational reasons.

12. Our liability to you

12.1 Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any breach of your statutory rights under the Consumer Rights Act 2015, including the terms implied by sections 9 to 11 and 13 to 16 of that Act; or
  • any other liability that cannot lawfully be limited or excluded.

12.2 Subject to section 12.1, if we fail to comply with these Terms we are responsible for loss or damage you suffer that is a foreseeable result of our breach. Loss or damage is foreseeable if it was obvious that it would happen, or if it was contemplated by both you and us at the time the contract was formed.

12.3 We are not responsible for loss or damage that was not foreseeable, or for loss caused by you failing to follow instructions or warnings supplied with the goods.

12.4 We do not supply goods for commercial, business or resale purposes. If you use the goods for such a purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

12.5 We are not responsible for the content of third-party websites linked from the Site. Links are provided for convenience only and do not imply endorsement.

13. Business customers

If you are not a consumer — that is, if you are buying in the course of a trade, business, craft or profession — then sections 8 and 9 do not apply to you, our liability to you is limited to the purchase price of the goods concerned, and the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 do not apply to your purchase. All other provisions of these Terms continue to apply.

14. Personal data

14.1 We process your personal data in accordance with our Privacy Policy, which explains what data we collect, why we collect it, how long we keep it and what rights you have.

14.2 Our online store is hosted on the Shopify platform. Shopify Inc. provides the e-commerce platform on which we sell our products and processes certain data on our behalf and on its own account in connection with the operation of the store. Details are set out in our Privacy Policy.

14.3 If you have a question or a complaint about how we handle your personal data, contact us at support@kids-planet.co.uk. You also have the right to complain to the UK Information Commissioner's Office (ICO) at ico.org.uk.

15. Events outside our control

15.1 We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event outside our reasonable control — including strikes, civil unrest, war, natural disaster, epidemic, fire, flood, failure of public or private telecommunications networks, failure of transport or postal networks, customs delays, or an act or omission of government.

15.2 If such an event occurs, we will contact you as soon as reasonably possible and will extend the time for performance by the duration of the event. If the delay lasts more than 30 days, you may cancel the affected order and we will refund you for any goods paid for but not delivered.

16. Changes to these Terms

16.1 We may change these Terms from time to time — for example to reflect changes in the law, in our services or in how we operate.

16.2 The version of these Terms that applies to your purchase is the version published on the Site at the time you place your order. Changes made afterwards do not apply retrospectively to that contract.

16.3 The date at the top of this page shows when these Terms were last updated. We recommend you review them each time you order.

17. General

17.1 If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in full force.

17.2 If we do not insist that you perform an obligation under these Terms, or if we delay in taking steps against you in respect of a breach, that does not mean we have waived our rights.

17.3 We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens and will make sure that it does not affect your rights under the contract.

17.4 The contract is between you and us. No other person has any right to enforce any of its terms.

18. Complaints and dispute resolution

18.1 If something has gone wrong, please contact us first at support@kids-planet.co.uk with your order number. We aim to acknowledge complaints within 5 working days and to resolve them as quickly as possible.

18.2 If we cannot resolve your complaint, you can obtain free, independent advice from Citizens Advice (citizensadvice.org.uk, consumer helpline 0808 223 1133) or from your local Trading Standards service.

18.3 Nothing in this section prevents you from taking legal action.

19. Governing law and jurisdiction

19.1 These Terms and any contract formed under them are governed by the law of England and Wales.

19.2 You and we both agree that the courts of England and Wales have jurisdiction over any dispute arising out of or in connection with these Terms. If you live in Scotland, you may also bring proceedings in the Scottish courts; if you live in Northern Ireland, you may also bring proceedings in the Northern Irish courts.

19.3 This choice of law does not deprive you of the protection given to you by the mandatory consumer-protection rules of the country in which you are habitually resident. If you are resident in the United Kingdom, you keep the full benefit of United Kingdom consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regardless of the fact that we are established in Hong Kong.
